Why this petition matters

Started by Rene Helmerichs

I'm a Canadian foreigner in Taiwan.  The Tainan City High Court denied me the right to have a Criminal trial.  It sounds unbelievable.  I was sick on the day of the trial, but the court proceeded anyway.  I gave my lawyer a letter from the doctor, but it didn't matter.  To make things worse, the court wouldn't allow me to call witnesses.  Two witnesses can verify that I am upholding the reputation of a cram school.  The prosecutor used a false Chinese translation to accuse me of extorting money from a cram school, threatening cram school managers (to get the money), and ruining the reputation of the cram school.  Two very credible witnesses (a doctor and an executive of the Sesame Street teacher education standard in Taiwan) can prove that the allegations are false.  I asked the court to have a retrial, but on 27 Feb 2024 the court refused.  Long ago, the cram school managers laughed at me when I told them that they are committing fraud.  They said no one in the Taiwan government will care.  The general manager implied that the school was above reproach of the law when the she told me that the owner of the school is so rich that he even donated a road to the government.

The Constitution of Taiwan (Republic Of China) says that everyone in Taiwan has the right to a fair trial (It's in Article 8 of the Constitution).  This is a petition to uphold the Republic Of China (Taiwan) Constitution.  The Constitution is the only document that keeps Taiwan separate from mainland China.  Without upholding the Constitutional rights of all people in Taiwan (including the foreigners and especially the people accused of mental illness), there is nothing to stop China from applying to the International Court to restore the Constitutional Rights in Taiwan.  Taiwan's Constitution is from 1947.  In 1947, the Republic Of China controlled all of China.  That means the "citizens" mentioned in Taiwan's Constitution include all people of China.  That's why the United Nations cannot allow Taiwan to be separate from China.  The people of China have to allow Taiwan to be a separate democratic nation.  The people of China legally own Taiwan according to the effective date of Taiwan's Constitution, and Constitution Articles 1 and 4.  Taiwan has its own currency, and its own military, but there are no official ambassadors from foreign countries in Taiwan.  Legally, Taiwan is only separate from China if it upholds the democratic rights of all people.  And that means allowing foreigners to have a fair trial.  Please support Taiwan democracy.  Sign this petition to help maintain democracy in Taiwan!
